Incomplete Applications
If a file is closed by Committee of Adjustment staff due to the determination that the application is incomplete, all but $100 per application may be returned to the applicant. These refunds will be processed by the Deputy Secretary-Treasurer of the Committee of Adjustment.
Withdrawn Applications
Requests for refunds for withdrawn Committee of Adjustment applications must be made in writing to the Deputy Secretary-Treasurer of the Committee of Adjustment.
Refunds may be granted by the Deputy Secretary-Treasurer of the Committee of Adjustment for:
- The withdrawal of consent and minor variance applications prior to internal circulation, in which case 80% of the application fee may be refunded; and
- The withdrawal of consent and minor variance applications after internal circulation but prior to the Notice of Hearing being mailed, in which case 50% of an application fee may be refunded.
There shall be no refund for withdrawal of an application once a Notice of Hearing has been mailed.
Other Refund Requests
Requests for partial or full refunds for a reason other than the withdrawal of an application must be made in writing to the Deputy Secretary-Treasurer and will be considered and a decision will be made by the Secretary-Treasurer of Committee of Adjustment or the Committee of Adjustment panel.

Amendments to this policy may be made from time-to-time as determined necessary for administrative purposes by the Secretary-Treasurer of the Committee of Adjustment at their discretion.
Tree Related Submission Requirements
Submission Requirements
All minor variance and consent applications must include the following tree-related materials to be accepted:
- Complete Tree Declaration Form
- Up-to-date colour photos showing the entire front and rear yard of the site regardless of if there are trees, and up-to-date colour photos of all by-law protected trees located on the site and within 6m of the site (12m with Ravine and Natural Feature Protected Areas).
- If there are no trees on site, up-to-date colour photos showing the entire front and rear yard of the site are still required.
- If unsure whether a tree is a by-law protected tree, a photo of the tree should still be submitted.
- If unable to provide a photo of a tree on a neighbouring property, indicate why and the application can still be accepted. Applicants should not enter private property without consent of the property owner.
- Each tree photo should show an unobstructed view of the tree from the ground to the tree top, where possible. If not possible, a “best effort” approach should be taken to show the trunk and the canopy of the tree with multiple pictures if necessary.
- Photos must be submitted in PDF format.
- A site plan showing the location of all by-law protected trees and tree protection zones, with species and diameter of each by-law protected tree at breast height.
- This plan is not required if there are no by-law protected trees on a site.
- If unsure whether a tree is a by-law protected tree, still show the tree on the site plan drawing.
By-law Protected Trees
- By-law protected trees include those on City property and can also be on private property:
- On City property, all trees are protected, regardless of size.
- On private property, trees with a diameter at breast height 30 centimetres or more are protected.
- On private property covered by the ravine by-law, all trees are protected, regardless of size.
An arborist report may be required for certain applications. Please contact Urban Forestry staff for more information.
Neighbourhood Character Guidelines
Committee of Adjustment Applications in the Village of Long Branch
At its meeting of January 31, 2018, City Council adopted Long Branch Neighbourhood Character Guidelines.
The Long Branch Neighbourhood Character Guidelines will be used in the review of all new development applications and public initiatives for all lands designated Neighbourhoods bounded by Lake Ontario to the south, the rail corridor to the north, Twenty Third Street to the east, and Forty Second Street (including Marie Curtis Park) to the west.
The Long Branch Neighbourhood Character Guidelines will be used by home builders, the community, City staff, committees and appeal bodies to provide direction in their decision making as they develop plans, review applications for redevelopment and/or enhance the public realm in the Long Branch Neighbourhood.
Long Branch Neighbourhood Character Guidelines and Performance Standards Checklist
Please review the Long Branch Neighbourhood Character Guidelines. You will be required to submit a rationale on the Performance Standards Checklist with your application explaining how your proposal meets these Guidelines.
